By accessing and using MendVibe ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

MendVibe is an AI-powered communication assistance tool designed to help co-parents improve their communication. The service provides:

• AI-generated message improvement suggestions
• Communication analysis and scoring
• Educational content about healthy co-parenting communication
• A calmer rewrite of a draft you paste in

3. AI-Generated Content Disclaimer

• You are solely responsible for reviewing and approving all AI-generated content before use
• AI responses are suggestions only and may not be appropriate for your specific situation
• No promise is made regarding the accuracy, completeness, or appropriateness of AI-generated content
• You must use your own judgment and discretion when using any suggestions

AI Limitations

• The AI may occasionally generate responses that are inaccurate, inappropriate, or contradictory
• You should never use AI suggestions that violate court orders, custody agreements, or parenting plans
• MendVibe does not review, approve, or endorse any AI-generated content

4. Family Court and Legal Proceedings

• You are responsible for ensuring all content is appropriate for legal proceedings
• No attorney-client relationship is created through use of this service
• You should consult with a qualified attorney for specific legal advice
• MendVibe is not responsible for any legal consequences of your communication choices

Compliance with Court Orders

• You are solely responsible for ensuring your communications comply with all court orders, custody agreements, restraining orders, and parenting plans
• MendVibe cannot and does not verify compliance with your specific legal obligations
• Failure to comply with court orders may result in serious legal consequences

5. Privacy and Data Handling

MendVibe handles message text as follows:

• Message text is sent to Cloudflare (AI Gateway), Anthropic, and OpenAI so they can produce a rewrite
• We do not write that message text into our database
• We store account email and usage counts needed to run the service
• Sign-in is encrypted in transit (HTTPS)

6. Service Limitations

• This service is a communication tool, not a substitute for professional therapy or legal advice
• No promise is made regarding conflict resolution or improved relationships
• You are responsible for your own communication choices and their consequences
• The service may not be appropriate for all co-parenting situations

7. User Responsibilities

• Use the service in accordance with applicable laws and regulations
• Maintain the confidentiality of your account credentials
• Not use the service for illegal, harmful, or inappropriate purposes
• Respect the rights and privacy of others
• Seek professional help when dealing with serious conflicts or legal issues

8. Prohibited Uses

You may not use MendVibe:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information

9. Limitation of Liability

In no event shall MendVibe, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page and updating the "Last updated" date.

12. Account Termination

We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court. You waive any right to a jury trial or to participate in a class action.

Governing Law: These Terms shall be governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles.

14. Indemnification

You agree to defend, indemnify, and hold harmless MendVibe and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including court orders or custody agreements
• Any communications you send based on AI suggestions
